“Evidence Loss Leads to Charges Dropped in Cold Case”

A recent development has led to the dropping of all charges against Todd Joseph Irving, 59, who was accused of the 1988 murder of P.E.I. teacher Byron Carr. The case took a turn when critical evidence necessary for a conviction mysteriously went missing. This revelation has raised questions about the implications for the case going forward.

Charlottetown Police Services disclosed that essential evidence had been lost, making it impossible to proceed with the prosecution. Consequently, the trial, scheduled to commence in November, could not proceed.

Police Chief Darren MacDougall explained that when the cold case was reopened in 2007, authorities were already aware that key items, such as the knife and towel connected to the crime scene, were no longer available. Despite the missing evidence, police attempted to build their case using DNA evidence collected from the scene.

The breakthrough in the case came in early 2024 when advances in investigative genetic genealogy linked Irving to DNA samples found at the crime scene. However, Irving’s DNA was not found on all pieces of evidence, raising doubts about the strength of the case.

Former Police Chief Brad MacConnell expressed hope that forensic evidence would be compelling enough to secure a conviction. However, as the trial approached, insurmountable challenges emerged, leading to the dropping of all charges against Irving.

The Crown Attorney’s Office only became aware of the missing evidence in July, a few months before the trial was set to begin. Christopher White, the Crown attorney, expressed disappointment that the case would not proceed to trial, highlighting its personal and public significance.

Despite the decision not to reopen the case against Irving, both the police and Carr’s family remain convinced that the correct individual was arrested. While acknowledging the tragic loss of Byron Carr, his brother John Carr emphasized that no amount of legal action could bring his brother back, underscoring the profound impact of the case on the family.
