A judge decided on Tuesday that Tyler Robinson, the individual accused of fatally shooting well-known U.S. conservative activist Charlie Kirk on a Utah college campus the previous year, will proceed to a trial for murder charges that could result in the death penalty. Utah District Court Judge Tony Graf made this decision during a hearing where prosecutors presented what they described as compelling evidence justifying a capital trial for Robinson, aged 23, in connection to the killing of one of the most significant figures in U.S. conservative politics.
Following the ruling on probable cause, an arraignment will be scheduled, with Robinson yet to enter a plea. The Utah County attorneys alleged that Robinson, a former apprentice electrician, was responsible for firing the fatal shot that claimed the life of Kirk, 31, during one of his signature campus debates that contributed to his national recognition.
Robinson is facing seven charges, including aggravated murder for placing others’ lives at risk during the event, a charge that carries the death penalty in Utah. Utah County prosecutor Ryan McBride displayed video evidence during the hearing that purportedly showed Robinson assuming a sniper position at Utah Valley University in Orem on September 10, 2025, before the shooting of Kirk. He argued that Robinson’s actions posed a significant danger to others, with Kirk’s security personnel in close proximity at the time of the incident.
McBride highlighted that the four rounds found in Robinson’s rifle indicated a readiness to fire additional shots if the initial one missed, thereby escalating the danger to bystanders. In contrast, defense attorney Staci Visser contended that the shooting only posed a threat to Kirk and did not meet the criteria for aggravated murder since Robinson did not engage with anyone else or reload the weapon, firing a single shot before fleeing the scene.
During the proceedings, the prosecutor referenced test results linking Robinson’s DNA to the alleged murder weapon, while the defense raised concerns about the reliability of such testing. McBride suggested that Robinson targeted Kirk due to his stances on same-sex marriage and transgender rights, presenting a text message allegedly sent by Robinson to his roommate Lance Twiggs implying a motive related to ideological differences.
In attendance at the courtroom were Kirk’s family members and his spouse, Erika, who now leads the conservative youth organization previously headed by her late husband. Charlie Kirk, a co-founder of Turning Point USA, was recognized for mobilizing young voters in support of former President Donald Trump’s re-election bid in 2024. The incident, captured on video and widely circulated on social media, is one of several attacks on U.S. political figures in recent times that have sparked discussions about political violence in a deeply divided nation.
At a memorial event following Kirk’s death, Erika Kirk expressed forgiveness towards the accused shooter but did not comment on the death penalty aspect of the case.
