Conditional Discharge Granted for Student in High School Attack

The sentence of the student who attacked two staff members at Charles P. Allen High School in March 2023 has been modified from probation to a conditional discharge. Judge Elizabeth Buckle approved the change in a Halifax court session on Friday, following a request from the defense.

Judge Buckle highlighted that the teenager has future educational and career aspirations that involve volunteer work and extracurricular activities. The conditional discharge will shorten the period during which his youth criminal record is accessible, reducing it from five years to three. Consequently, as of March 2027, his record will not show up on criminal record or vulnerable sectors checks, allowing him to pursue opportunities that will bolster his application for a competitive post-graduate program while pursuing his undergraduate degree.

Although the duration and conditions of his sentence remain unchanged, including a weapons ban and curfew, they will expire by the end of September. Originally, the student received a two-year probation sentence in September 2024 after pleading guilty to two counts of aggravated assault.

Judge Buckle emphasized that the disparity in record access durations between discharge and probation is crucial for the student’s career plans. She explained that a probation order and a conditional discharge offer a similar level of accountability, indicating that altering the sentence would not have a practical effect on the victims.

The Crown did not contest the sentence modification, with Prosecutor Terry Nickerson stating that the decision aligned with the law. Despite this, Angela Light, the administrative assistant who was one of the victims and remains absent from work since the incident, expressed disappointment at the court proceedings. She expressed concern that the perpetrator would now have the opportunity to work and volunteer with vulnerable individuals earlier than anticipated.

Light also voiced frustration over alleged communication issues from the Crown, stating that she was unaware of the sentence review until recently. She highlighted her ongoing struggles with post-traumatic stress disorder resulting from the attack, emphasizing that closure remains elusive for her despite the legal proceedings.
