The appeal of a man challenging his sexual assault sentence has been rejected by the Yukon Court of Appeal. Rudra Amin, now residing in Calgary, was convicted in 2023 of assaulting three women in Whitehorse from 2017 to 2018. The victims reported the incidents in 2020, leading to Amin being found guilty of four counts of sexual assault following a jury trial.
After his sentencing, Amin promptly lodged an appeal and was subsequently released on bail. In his appeal, Amin sought a reduction of two months from his slightly over two-year sentence to become eligible for a conditional sentence order, citing concerns about potential immigration consequences.
Justice Susan Griffin, in her ruling dated August 6, dismissed the appeal. Griffin refuted Amin’s argument that errors were made by the initial sentencing judge and concluded that granting Amin’s request for a conditional sentence would not be suitable. Griffin emphasized that Amin’s plea to shorten his sentence lacked merit unless he could demonstrate a fundamental error affecting the sentencing.
Griffin stated, “This is merely minor adjustment and falls outside the scope of this court’s jurisdiction.” Amin will now serve his original sentence of slightly over two years.
