“Former City Council Member Convicted of Historical Sex Offenses”

A former city council member in Penticton, British Columbia, has been convicted for the second time by a judge in the Ontario Superior Court for historical sex offenses involving minors. The victim, accompanied by family, was present in court when Justice Jason Howie rendered the verdict.

James Miller was found guilty of multiple charges, including sexual interference, sexual assault, and invitation to sexual touching, related to his time as a youth basketball coach during the 1990s. Justice Howie emphasized the credibility and clarity of the victim’s testimony, describing a pattern of behavior starting with innocent interactions and escalating to sexual abuse.

The victim, now in his 40s, testified about his modest upbringing and his mother’s struggles with alcoholism. Testimony revealed that Miller provided the victim with experiences and opportunities his family couldn’t afford, which the victim perceived as privileges and considered Miller his best friend.

In the court proceedings, it was disclosed that Miller financially assisted the victim in purchasing a vehicle and stayed at his home with his young son. Despite a supportive relationship, the victim reported the abuse to the authorities in October of the year following Miller’s initial charges in 2024. The court dismissed the notion of a transactional relationship between Miller and the victim.

Justice Howie disregarded Miller’s attempt to distance himself from the victim, highlighting inconsistencies in Miller’s memory regarding his coaching history. The judge found it implausible that Miller could not recall key details of his relationship with the victim over the years.

In a previous trial, Miller was also found guilty of similar charges. Sentencing for both cases is scheduled for November 19 and December 14. The City of Penticton has removed Miller from his council position, which will remain vacant until the next municipal election.
