“Charlottetown Homicide Case Dismissal Sparks Calls for Impartial Investigation”

Calls for an impartial assessment have escalated following the dismissal of charges in a homicide case due to the loss of crucial evidence by Charlottetown Police Services. The P.E.I. Crown Attorneys’ Office stated on Tuesday that all charges linked to the murder of Byron Carr, who was strangled and stabbed in his home in November 1988, would be withdrawn due to the absence of a knife and the towel used in the crime scene.

Josie Baker, the executive director of PEERS Alliance, expressed concern that the case has impacted individuals in Charlottetown’s 2SLGBTQ+ community, instilling fear among the populace. Dave Stewart, a member of P.E.I.’s queer community who resided in Charlottetown during the 1980s, described the period following Carr’s murder as a time of intense apprehension, citing the threatening message left on Carr’s bedroom wall.

Todd Joseph Irving faced charges of first-degree murder and tampering with human remains in January 2024, based on substantial forensic evidence linking him to Carr’s death. Despite pleading not guilty, Irving’s trial was set to commence in November.

Stewart and Baker are both advocating for a review, emphasizing the necessity for an independent investigation to scrutinize the potential role of homophobia in the case. They stressed that recent developments have reignited past traumas, particularly among gay men of their generation. Baker called for an inquiry to pinpoint the shortcomings and prevent their recurrence, underscoring the significance of valuing human life and ensuring justice for all.

The Justice and Public Safety Department of the province affirmed its engagement with Charlottetown Police Services to determine the appropriate scope for a directed review. Interim Police Chief Darren MacDougall expressed readiness for an independent inquiry, acknowledging the challenges posed by the passage of time and changes within the police force. MacDougall highlighted the importance of accountability and pledged support for measures to address past actions that have impacted the community.
