The Thunder Bay District Health Unit (TBDHU) has resorted to legal action against the owner of a seniors’ apartment complex over numerous health code violations. Abby Mackie, a public health inspector at TBDHU, mentioned that they had issued compliance orders to SMS Property Trust Inc. following complaints about issues like high temperatures, overflowing trash, and bed bug infestations at Vickers Manor.
Vickers Manor, previously known as McKellar Place, provides living accommodations for seniors and also includes assisted living units managed by Brain Injury Services of Northern Ontario. The property, situated at 325 Archibald St. S. in Thunder Bay, is currently on the market for $1, down from its earlier listing price of $18.9 million this year.
Apart from health code breaches, the owner is confronted with numerous fire code violations and faced challenges such as unpaid bills that almost led to utility cutoffs. A crowdfunding campaign was initiated by volunteers to ensure residents received meals after the cessation of hot meal services.
SMS Property Trust Inc., owned by Ongrasothy Masillamany of Markham, is facing 36 offenses under the Health Protection and Promotion Act concerning excessive heat within the building. The owner has been summoned to court, with a hearing scheduled for November 25 to determine potential fines if found guilty.
The City of Thunder Bay has been actively monitoring the situation at Vickers Manor to prevent service disruptions that could endanger tenants. NDP MPP Lise Vaugeois has been advocating for an investigation by Ontario’s Rental Housing Enforcement Unit to ensure compliance with the Residential Tenancies Act.
Residents like Sharon Zoschke, who moved from Ottawa to Thunder Bay, expressed their attachment to Vickers Manor due to its community atmosphere and historical significance. Despite challenges, Zoschke and other tenants are hopeful for a positive resolution and seek better communication regarding any building-related changes.
